QC-195: Bill 195: An Act limiting the use of personnel placement agencies’ services and independent labour in the educational childcare sector

This bill directly affects two groups in Quebec: subsidized childcare centres (CPEs, subsidized daycares, and home childcare providers) and for-profit personnel placement agencies that supply workers to the childcare sector. A typical CPE director who currently calls a commercial staffing agency when an educator is sick would be prohibited from doing so — they'd need to find coverage through a non-profit or cooperative agency instead. For-profit staffing agencies that place childcare workers lose access to this client base entirely unless they convert to a non-profit or cooperative structure. Agencies that are permitted to operate (non-profit or co-op) face new administrative burdens: mandatory $2M liability insurance, anti-solicitation rules, written employment contracts with workers, semi-annual reporting to the Minister, and prohibitions on enforcing non-compete clauses against workers hired away by childcare providers. Home childcare providers may also face restrictions on using independent labour, to be set by future regulation.
