Any business or individual operating in the Northwest Territories could be affected if their property is suspected of being connected to unlawful activity — this is especially relevant for industries like transportation, real estate, retail, and financial services where assets could be flagged as instruments or proceeds of crime. A landlord who rents property where drug trafficking occurs, a business owner whose vehicle is used without their knowledge for illegal purposes, or someone who unknowingly purchases property tied to criminal activity could all face forfeiture proceedings. Banks, credit unions, and lenders with registered security interests in property are given some protection, but must respond to Director information requests within specified deadlines or face penalties. Businesses structured as corporations should note that directors and officers can be personally liable for offences committed by the corporation under this Act.
