Bill 98: Building Homes and Improving Transportation Infrastructure Act, 2026

The bill touches a wide range of Ontario businesses. Residential developers and homebuilders — from small infill builders to larger tract developers — operating anywhere in Ontario will find it easier to get projects approved, as municipalities lose the power to require EV charging infrastructure, impose certain minimum lot sizes, or add 'sustainable design' conditions during site plan approval. Non-profit retirement home developers across the province no longer have to pay development charges, which directly reduces the upfront cost of building seniors housing. Private companies looking to build and operate water or sewage infrastructure outside of municipal systems now have a clearer path to getting municipal consent, which could open new business opportunities in growth areas. Transit operators and municipalities in the Greater Toronto and Hamilton Area — including agencies like the TTC and regional transit systems — will need to integrate fare payment systems, share fare revenue according to provincial formulas, and file regular compliance reports with the Minister of Transportation.
