Day-to-day, these operators will need to gather engineering reports, document that work is not cosmetic or routine, prove costs were incurred through arm's-length transactions, and account for any government subsidies received — all before filing an AGI application with the Landlord and Tenant Board. Both small landlords with a handful of units and large institutional property owners are affected, though the added documentation burden may be proportionally heavier for smaller operators who lack in-house compliance staff. Landlords must also now provide tenants with 30 days' notice before the rent reduction date when an AGI expires, or face a penalty of 1.5 times any overpayment.
