What this bill does
This Alberta bill prohibits non-disclosure agreements (NDAs) and non-disparagement agreements that silence victims of sexual misconduct or sexual exploitation as part of settlement agreements. It voids such agreements — whether signed before or after the law takes effect — and makes entering into them a punishable offence.

This bill affects any Alberta employer, business owner, or organization that has ever used or might consider using settlement agreements to resolve workplace sexual harassment or misconduct complaints. Whether you run a small restaurant, a construction company, a corporate office, or any other workplace, you can no longer include confidentiality or non-disparagement clauses in settlements that would prevent an employee or claimant from speaking about sexual misconduct they experienced. Businesses that have already signed such agreements should be aware those clauses are now void. Corporations face fines up to $50,000, and individual officers, directors, or managers who authorize or allow these agreements can personally face fines up to $10,000.
